SPAM Filter Terms and Conditions.

1. Interpretation

1.1 The following words have the following meanings:
Anti spam Filter means the feature that scans inbound SMTP e-mail sent to Mailboxes and is designed to delete e-mail classified by the Anti-spam Filter as Spam.
AS Filter means Anti-spam Filter.
Mailbox means an e-mail account address provided by Us.
SMTP means “Simple Mail Transfer Protocol”, a TCP/IP protocol used in sending and receiving e-mail.
Spam means unsolicited e-mail which is sent to multiple e-mail addresses using mass electronic distribution.
Us, We or Our means Online Connect P/L. ABN 75 069 967 120.
Virus means any “back door”, “time bomb”, “trojan”, “worm”, “drop dead device”, “virus” or any computer software code which is intended or designed to:
(a) permit access to or use of software or systems by a person not authorised by the software or system owner or licensee; or
(b) disable, damage, erase or disrupt or impair the normal operation of software or data without the consent of the owner or licensee.
You or Your means the person named on the Registration Form provided by Us as being an account holder.
Your Co-users means anyone that is permitted by us, and authorised by You, to use Your Mailbox.


2 Anti-spam Features

2.1 If You elect to be provided with the Anti-spam Filter, then You and Your Co-users’ consent to its inbound e-mails being deleted in accordance with the Anti-spam Filter.
2.2 The AS Filter is provided “as is” and, to the extent permitted by law, We exclude all implied warranties, whether statutory or otherwise, with respect to the AS Filter and its individual functions (including the Accompanying Documents). We do not warrant that the AS Filter will operate without error.
2.3 To the extent permitted by law, neither We nor any of Our providers or licensors shall be liable in tort (including negligence), contract, under statute or otherwise for any direct or indirect loss or damage (including loss of profits or anticipated savings, economic loss or any indirect or consequential damage) incurred by You, Your Co-users or any other person arising from or connected in any way with the AS Filter, including without limitation, any use or attempted use of the AS Filter, any malfunction, cessation or interruption of the supply of the AS Filter, or any failure to update or delay in updating any component of the AS Filter including new virus signatures or rule updates.
2.4 You or Your Co-users:
(a) must not falsify, forge, or otherwise tamper with any portion of the header or tracking data of any SMTP e-mail message; and
(b) must not use the AS Filter to originate, send or relay Spam or intentionally launch Viruses.
2.5 You must promptly make Your Co-users aware of the terms and conditions set out above and obtain their consent to be bound by those terms.
